Information Technology and Cyber Law

In criminal matters involving information technologies, we act as defence counsel, represent victims and complainants and assist clients throughout criminal complaint procedures. In civil and commercial matters such as software rights and e-commerce, we provide preventive legal advice, help prevent infringements and represent clients in disputes and litigation.

Cybercrime Investigations and Criminal Proceedings

We represent clients in investigations and criminal proceedings concerning unauthorised access to an information system (Turkish Criminal Code No. 5237, Article 243), interference with or disruption of an information system and the destruction or alteration of data (Article 244), credit card cloning and the misuse of bank or credit cards (Article 245), cyber-enabled fraud and blackmail.

Social Media Offences and Cyberbullying

We provide defence counsel services and represent victims in cases involving insult (Article 125), threats (Article 106), blackmail (Article 107) and violation of privacy (Article 134) committed through social media platforms such as Instagram, X and Facebook.

We also provide legal assistance with actions carried out through fake or anonymous accounts, including the preservation and collection of digital evidence and the identification of IP addresses through lawful procedures.

Cryptocurrency and Digital Asset Disputes

We provide legal assistance in disputes involving unjustified account freezes on cryptocurrency exchanges, unauthorised transfers and cyber fraud committed through phishing.

Our services also cover legal processes involving the preservation and examination of digital records such as transaction IDs (TXIDs) and wallet addresses.

KVKK Compliance and Data Breach Notifications

We advise companies on complying with their obligations under Turkish Personal Data Protection Law No. 6698 (KVKK).

Our services include preparing personal data processing inventories, drafting privacy notices and explicit consent forms and handling registration procedures before the Data Controllers Registry (VERBIS). Following a cyberattack or data leak, we also provide legal assistance with breach notifications to the Personal Data Protection Board within 72 hours and challenges against administrative penalties.

Removal of Online Content and Blocking of Access

We take legal action against online publications that infringe personality rights, contain false allegations or violate privacy. Depending on the nature of the infringement, available remedies may include requests for the removal of content, restriction of access and applications to courts, public authorities, online platforms, search engines and relevant service providers under Law No. 5651 and other applicable legislation.

We also assist clients with reputation-damaging content, fake social media accounts and requests based on the right to be forgotten.

Protection Against Software, Source Code and Content Theft

We take legal action against the unauthorised copying, scraping or commercial use of source code and original website content, which are among the most valuable assets of digital projects.

Under Law No. 5846 on Intellectual and Artistic Works, including its provisions protecting computer programs, we represent clients in establishing infringements of economic and moral rights, preventing or ending infringements and claiming compensation for resulting losses.

Preparation of Software Escrow Agreements

We prepare software escrow agreements designed to minimise the risks between software development companies and their customers.

Under these agreements, the software’s source code is deposited with a trusted independent third-party escrow agent. This helps protect the customer’s business continuity if the developer becomes insolvent or is no longer able to provide maintenance and support.

Domain Name and Trademark Disputes

We handle proceedings for the cancellation or transfer of domain names registered in bad faith that incorporate another party’s registered trademark. This includes WIPO-administered proceedings under the Uniform Domain Name Dispute Resolution Policy (UDRP) in cases involving cybersquatting.

We also assist with disputes involving TRABIS and .tr domain names and with the prevention of trademark infringement on digital platforms under Industrial Property Code No. 6769.

We assist businesses with international commercial disputes arising from their activities on global B2B and cross-border e-commerce platforms such as Alibaba, TurkishExporter and Kompass.

For domestic operations, we provide legal advice under Law No. 6563 on the Regulation of Electronic Commerce and the Distance Contracts Regulation. Our services include establishing the legal framework of e-commerce websites and preparing membership terms, sales agreements and other required contractual documents.
