An incorrect filing of a trademark registration application may lead to problems such as the rejection of the application or objections, as well as much more serious legal and financial problems in the later process.<\/p>\n\n\n\n<p>Items of\u00a0actual loss\u00a0were listed in a decision of the Court of Cassation (Yarg\u0131tay)\u00a0as: \u201c&#8230;The\u00a0costs\u00a0incurred for the prevention of the\u00a0infringement of the trademark right,\u00a0litigation costs, loss of market share in the goods or services market, the investments becoming futile during this process, excessive payments made to the employed personnel during this process, and the\u00a0costs\u00a0incurred for compensating this (such as\u00a0costs\u00a0for promotion, changing molds and packaging, image renewal, image recall, elimination of confusion, etc.)&#8230;\u201d<a id=\"_ftnref1\" href=\"#_ftn1\"><sup>[1]<\/sup><\/a>.<\/p>\n\n\n\n<p>The owner of the infringed&nbsp;trademark right&nbsp;can also claim their&nbsp;loss of profit, in addition to their&nbsp;actual loss, by choosing one of the following three rights (Law No. 6769, Art. 151):<\/p>\n\n\n\n<p>a) The probable income the right owner would have obtained if there were no competition from the&nbsp;infringer.<\/p>\n\n\n\n<p>b) The&nbsp;net profit&nbsp;obtained by the&nbsp;infringer.<\/p>\n\n\n\n<p>c) The&nbsp;license fee&nbsp;the&nbsp;infringer&nbsp;would have had to pay if they had&nbsp;lawfully&nbsp;used this right with a&nbsp;license agreement.<\/p>\n\n\n\n<p>The owner of the infringed trademark right has the right to claim the most advantageous of these three options. The fact that the Law specifies such detailed calculation methods shows that the cost of trademark infringements can be extremely high.
